Criminal Law in the Armed Forces
An examination of the practice of military justice in the United States, and its sources of authority under the Constitution, the Uniform Code of Military Justice (UCMJ), and the Manual for Courts-Martial (MCM). The seminar will address the history of military justice in the United States; an extensive analysis of the UCMJ as enacted by Congress and as amended since 1951; a discussion of the different types of crimes proscribed by Congress in the UCMMJ; military jurisdiction; the Military Rules of Evidence (MREs); military trial practice and procedure; the organization, composition and function of the various service appellate courts and the United States Court of Appeals for the Armed Forces; the military lawyer and how the service Judge Advocate General departments are organized within the Department of Defense; the function and authority of the military commander under the UCMJ; significant military cases reaching the U.S. Supreme Court and other federal courts; and a comparative analysis of other military systems.
The offering of this seminar is extremely timely because of the pending commemoration of 50 years of military justice under the Uniform Code of Military Justice and the United States Court of Military Appeals (now the United States Court of Appeals for the Armed Forces), including a major event involving Chief Justice Rehnquist.
