Constitutional challenges have become increasingly important in environmental litigation. In this seminar we will explore the regulatory takings doctrine, the commerce power, principles of federalism, the public trust doctrine, the treaty power, the federal property clause, equal protection and environmental justice, and state constitutional rights, as they relate to air and water pollution, the protection of wetlands, rivers, forests, and coastal zones, the conservation of wildlife, fuel and other resources, and problems of climate change. Students may write a term paper or take an open-book essay examination.
