Globalization & Domestic Courts
This course will look at the special role international law has for domestic courts, including the question of what effects decisions by the International Court of Justice have, and to what extent domestic courts act as enforcers of international law (the theory of dédoublement fonctionnel). We will look at transnational collaborations among courts, through informal networks and formal procedures, and we will look at transnational competition between courts.
Students will be expected to write brief reaction papers for individual sessions, and to write a final research paper.
