Moot Court in Jennings v. Stephens

Duke Law students, faculty and staff are invited to join Andrew Oldham, Deputy Solicitor General of Texas, for a moot court in Jennings v. Stephens. This case is set to be argued in front of the US Supreme Court on October 15th, 2014. The question presented is: Whether a federal habeas petitioner who prevailed in the district court on an ineffective assistance of counsel claim must file a separate notice of appeal and motion for a certificate of appealability to raise an allegation of deficient performance that the district court rejected even though the court of appeals acquired jurisdiction over the entire claim as a result of the respondent's appeal.
