Legal scholar and author Bernhard Schlink will present the Herbert L. Bernstein Memorial Lecture titled, "Proportionality in Constitutional Law: Why Everywhere but Here?" Today the principle of proportionality plays a dominant role in constitutional law worldwide. This lecture examines where the principle comes from, why it plays the role it plays, and why American constitutional scholarship and jurisprudence are reluctant to embrace it. Professor Schlink is both a respected legal scholar and the acclaimed author of a number of popular works of fiction, including the novel, The Reader. Lunch will be provided.
