Question #4

Locate both the International Court of Justice (ICJ) decision concerning East Timor (Portugal v. Australia) and the counter memorial of the Australian government.

Recommended answer is:

You can find this case in Reports of Judgments, Advisory Opinions and Orders, the official reporter for the ICJ, by searching the index of the1995 volume by parties or subject. The decision is also available on the ICJ website, where decisions are listed both chronologically and by country. ICJ cases are also available on Westlawand Lexis Nexis.

The official source for pleadings is Pleadings, Oral Arguments, and Documents. Pleadings are published after the judgment (and sometimes not until long after); the pleadings for this case are not yet available in print. Written and oral pleadings for this case are available on the ICJ website as electronic documents (be aware that the ICJ considers these pleadings to be an early, not corrected version ). You should cite unpublished recent materials to the ICJ website (see Bluebook Rule 21.5.1(h)); for example: Counter-memorial of the Government of Australia (Port. v. Austl.) (Concerning East Timor) (June 30, 1995) at http://www.icj-cij.org/icjwww/icases/ipa/iPApleadings/ipa_ipleadings_19911118_MemorialPortugal_toc.pdf .

The citation in Bluebook form for the decision is: Concerning East Timor (Port. v. Austl.), 1995 I.C.J. 90 (June 30) (see Bluebook rule 21.5.1).

See International Organizations: United Nations for more advice on finding ICJ documents.
