When do our courts have jurisdiction? When should they apply foreign law? Under what circumstances should they recognize and enforce foreign judgments? These are the questions of conflict of laws. They occur frequently between States of the US, but also internationally. Courts frequently base their decisions on the Restatement (2nd), which is, however, not only contested, but also which focuses almost exclusively on interstate conflicts. Professor Ralf Michaels will report on a current project at the American Law Institute for a new Restatement. He will focus especially on the importance of comparative law and international conflicts in the drafting process. This presentation is in connection with a conference, co-sponsored by the Duke Journal of Comparative and International Law and the American Law Institute, that will look at these questions in more depth on November 4-5.
