238.05 Ethics and the Law of Lawyering
In this course we will investigate and discuss lawyer professional conduct rules and how they may intersect with ethics and compliance laws and regulations facing corporate clients operating in a multinational setting. We will explore issues of confidentiality, attorney-client privilege, duties to clients, and duties to governments, other attorneys, and citizens and societies under the different views held in common law and civil law systems. Our primary focus will be on the ABA Model Rules of Professional Conduct. We also will consider how attorneys must navigate the professional conduct rules governing attorneys while counseling clients on international ethics and compliance laws and regulations on human rights, anti-corruption, export and sanctions, antitrust, immigration, and data privacy. This should help prepare students for ethical and legal issues they may face in cross-jurisdictional practice.
