Supreme Court Moot: Gamble v. United States

Duke Law faculty will moot Texas Solicitor General Kyle Hawkins in preparation for his oral argument as amicus curiae in Gamble v. United States. Gamble raises the question whether the Court should abolish the 'separate sovereigns' doctrine that permits both state and federal authorities to try a criminal defendant for similar crimes without violating the Double Jeopardy Clause of the Constitution.
