Former AUSA Andy McCarthy: "Why We Need a National Security Court"

November 05, 2009 • 12:15 PM • Law School 3037

Former AUSA and National Review Contributing Editor Andy McCarthy will discuss "Why We Need a National Security Court." Mr. McCarthy will discuss the state of play in the 90s when we used the criminal justice system, why this was inadequate to protect the country, why we need a law-of-war paradigm (that permits detention without trial), the problems with using the military justice system for this purpose, why allowing the courts to make up their own system
as they go along is both a policy disaster and a violation of the constitutional framework, what national security court would look like, and -- looking at recent developments -- the price we are now paying for failing to create a national security court. Non-pizza lunch served. For more information, contact Erica Stalnecker at ems14@duke.edu.
